1. Acceptance of Terms

By accessing or using Bright Neighbors — including any web pages, features, tools, or data accessible at sunledger.polsia.app or any associated domain — you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Terms"). These Terms constitute a legally binding agreement between you and Bright Neighbors.

If you do not agree with any provision of these Terms, you must not use Bright Neighbors. Your continued use of Bright Neighbors following any updates to these Terms constitutes your acceptance of the revised Terms.

If you are accessing Bright Neighbors on behalf of an organization or company, you represent that you have authority to bind that entity to these Terms, and "you" refers to both you individually and that entity.

2. What Bright Neighbors Is

Bright Neighbors is a free community utility designed to provide solar price transparency for Hawaii homeowners. Bright Neighbors aggregates and displays solar installation pricing data drawn primarily from public building permit records maintained by the City & County of Honolulu Department of Planning and Permitting, supplemented by voluntarily submitted data from users.

Bright Neighbors is a community information platform. It is not:

  • A licensed contractor referral or lead-generation service
  • A registered financial advisor or investment advisory service
  • A solar installation company or contractor
  • A licensed real estate or property valuation service
  • An agent or representative of any solar installer, financing company, or utility

Nothing on Bright Neighbors constitutes professional financial, engineering, real estate, or contractor advice. Bright Neighbors is a tool to help you understand market context — not a substitute for consultation with qualified professionals.

3. Free Service — No Warranties on Accuracy

Bright Neighbors is provided free of charge as a community resource. In exchange for free access, please understand the following limitations on data quality:

  • Public permit data: Solar pricing information is sourced from public building permit records filed with the City & County of Honolulu Department of Planning and Permitting. These records may contain clerical errors, omissions, outdated figures, or data entry mistakes that originated with the permit applicant or the permitting authority. Bright Neighbors performs data cleaning but cannot guarantee the accuracy of the underlying records.
  • User-submitted data: Pricing data, quotes, and other information submitted by Bright Neighbors users has not been independently verified or audited. User submissions represent self-reported figures that may be inaccurate, incomplete, or fabricated.
  • Market currency: Solar equipment costs, labor rates, and incentive structures change frequently. Bright Neighbors does not guarantee that any pricing data reflects current market conditions at the time you view it.
  • Situational inapplicability: Pricing averages and benchmarks are derived from historical installations across a range of properties. Your specific home, roof configuration, electrical system, shading, and other factors can cause actual costs to differ materially from displayed figures.
Important

Do not rely solely on Bright Neighbors data when making solar purchasing decisions. Bright Neighbors data is a starting-point benchmark, not a quote or commitment. You should obtain multiple professional quotes from licensed contractors before signing any solar installation agreement.

Bright Neighbors makes no warranty, express or implied, regarding the accuracy, completeness, reliability, fitness for a particular purpose, or timeliness of any data or content on the platform.

4. User-Submitted Data: License Grant

When you submit information through any Bright Neighbors form — including solar quote data, installation pricing, installer reviews, system specifications, or any other structured or unstructured data ("User Submissions") — you grant Bright Neighbors a perpetual, worldwide, royalty-free, irrevocable, sublicensable license to:

  • Anonymize and aggregate your submission, stripping personally identifiable information to produce community-level statistics
  • Display aggregate and anonymized statistics publicly — including neighborhood $/watt averages, benchmark price ranges, installation trend charts, geographic heat maps, installer performance summaries, and similar derived data products
  • Use aggregate data in research, reporting, and marketing materials — including public blog posts, press coverage, investor materials, and educational content about Hawaii solar markets
  • Retain and use aggregated, anonymized data even after you delete your account or request removal of your personal information

This license is limited to uses consistent with the anonymized, aggregate nature described above. Bright Neighbors will not publish your individual submission in a form that identifies you personally without your separate explicit consent, except as required by law.

Survival on account deletion: This license survives account deletion for data that has already been incorporated into aggregate statistics or anonymized data products. Deletion of your account removes your individually identifiable records; it does not and cannot retroactively remove your contribution from aggregate figures that have already been computed and published.

You represent and warrant that you have the right to submit any data you submit, that your submissions do not infringe the intellectual property rights of any third party, and that your submissions are truthful and accurate to the best of your knowledge.

5. Third-Party Data Sharing — Express Per-Instance Consent

Your Privacy Commitment

Bright Neighbors will NOT share your personally identifiable information (PII) with any third party without a separate, affirmative consent action from you at the specific moment of that data-sharing event. Agreeing to these Terms does not constitute consent to any third-party data sharing.

The following rules govern how and when Bright Neighbors may share your personal information with third parties:

5.1 The Per-Instance Consent Requirement

Any time Bright Neighbors proposes to share your personally identifiable information with a named third party for a specific purpose, you will be presented with a discrete consent action — specifically, a checkbox or opt-in toggle — that clearly and prominently states: (a) exactly what data will be shared, (b) the identity of the third party receiving it, and (c) the specific purpose for which it will be used. You must take that affirmative action for sharing to occur.

5.2 What Does Not Count as Consent

  • Agreeing to these Terms of Service does not constitute consent to any third-party data sharing
  • Creating an account or submitting solar pricing data does not constitute consent
  • Passively browsing the platform does not constitute consent
  • Failure to opt out does not constitute consent — Bright Neighbors uses opt-in, not opt-out, for third-party sharing
  • Consent to one data-sharing event does not carry over to future events, even with the same third party for the same stated purpose — each instance requires its own affirmative action

5.3 Types of Third Parties

The following categories of third parties may, in the future and only with your per-instance consent, receive your personally identifiable information:

  • Licensed solar installers operating in Hawaii
  • Solar financing companies and loan originators
  • Energy service providers and utility programs
  • Other participants in the Hawaii residential solar ecosystem

5.4 Withdrawing Consent

You may withdraw any previously given consent to third-party data sharing at any time by emailing privacy@sunledger.polsia.app. Withdrawal is effective prospectively — it does not undo a disclosure that has already occurred, but Bright Neighbors will promptly notify the relevant third party of your withdrawal and request that they cease using your data where technically and legally feasible.

5.5 Future Data Sharing Services

Bright Neighbors reserves the right to introduce data licensing services in the future. When such services launch, the per-instance consent framework described in this Section 5 will govern them in full. Your personally identifiable information will not be shared with any third party without your affirmative, per-instance opt-in at the time the sharing occurs. We will update these Terms and provide advance notice before launching any such services.

5.6 Exceptions

The per-instance consent requirement does not apply to: (a) disclosures required by applicable law, court order, or governmental authority; (b) disclosures to service providers acting as data processors on Bright Neighbors's behalf under appropriate data processing agreements (e.g., hosting providers, analytics vendors) who are contractually prohibited from using your data for their own purposes; or (c) disclosure of anonymized, aggregate data that cannot reasonably be used to identify you.

6. Prohibited Uses

You may use Bright Neighbors only for its intended purpose as a personal, non-commercial solar pricing research tool. The following uses are expressly prohibited:

  • Automated data extraction: You may not scrape, crawl, spider, index, or systematically extract data from Bright Neighbors using bots, scripts, browser extensions, or any other automated means. This includes permit data, user-submitted data, aggregate statistics, and any other content on the platform.
  • Commercial redistribution: You may not commercially resell, license, sublicense, or distribute Bright Neighbors data — including public permit data compiled and displayed by Bright Neighbors — to third parties, whether directly or as part of a data product, API, or service.
  • Spam and unsolicited communications: You may not use Bright Neighbors, any contact information obtained through Bright Neighbors, or any data derived from Bright Neighbors to send unsolicited commercial communications, marketing messages, or spam to any person.
  • Fraudulent submissions: You may not submit false, fabricated, misleading, or significantly inaccurate data through any Bright Neighbors form. Intentionally corrupting community price data harms other users and degrades the platform for everyone.
  • Platform interference: You may not attempt to reverse-engineer, decompile, hack, probe, overload, or disrupt the Bright Neighbors platform, its servers, databases, or infrastructure. This includes denial-of-service attacks, credential stuffing, and vulnerability exploitation.
  • Unauthorized access: You may not access any portion of Bright Neighbors that is not intended for public access, or attempt to circumvent authentication or access controls.
  • Unlawful purposes: You may not use Bright Neighbors for any purpose that violates applicable federal, state, or local law, including the Hawaii Revised Statutes.

Bright Neighbors reserves the right to investigate suspected violations and to take any appropriate action, including account suspension, IP blocking, and referral to law enforcement.

<\!-- SECTION 7: TERMINATION -->

7. Account Termination

Termination by Bright Neighbors: Bright Neighbors reserves the right to suspend, restrict, or permanently terminate your account and access to the platform, with or without prior notice, if we determine in our reasonable judgment that you have: violated any provision of these Terms; engaged in any prohibited use described in Section 6; submitted fraudulent, fabricated, or intentionally misleading data; attempted to harm other users or the integrity of the platform; or engaged in any conduct that exposes Bright Neighbors to legal liability.

Where feasible, Bright Neighbors will provide notice of termination and an opportunity to respond before permanent account deletion, except in cases of serious violations where immediate action is warranted to protect other users or the platform.

Termination by you: You may delete your account at any time by contacting support@sunledger.polsia.app. Upon account deletion, your personally identifiable information will be removed from active user records in accordance with our Privacy Policy. As described in Section 4, your contribution to aggregate, anonymized data products cannot be retroactively removed.

Effect of termination: Termination does not affect any rights or obligations that accrued before termination. Sections 4, 5, 10, 11, 12, and 13 survive termination of these Terms.

<\!-- SECTION 8: COMING SOON -->

8. "Coming Soon" Features

Certain features displayed or described on Bright Neighbors — such as "Request Quotes," "Compare Installers," "Financing Calculator," or other features labeled as "Coming Soon," "Beta," or "In Development" — are not currently active or fully operational. These features may be shown to gauge community interest, gather feedback, or indicate product direction.

Bright Neighbors makes no warranty, representation, or commitment that any "Coming Soon" feature will:

  • Launch on any particular timeline or at all
  • Function as described or depicted
  • Be made available free of charge
  • Remain available once launched

Displaying a "Coming Soon" feature does not create a contractual obligation for Bright Neighbors to build, launch, or maintain that feature. Bright Neighbors may modify, delay, or permanently cancel any planned feature without notice and without liability to you.

If you have submitted your email address or expressed interest in a specific coming-soon feature, that expression of interest does not constitute a contract, reservation, or guarantee of access.

<\!-- SECTION 9: FUTURE PAID FEATURES -->

9. Future Paid Features

Bright Neighbors is currently provided entirely free of charge. We intend to keep the core solar pricing data and benchmarking tools free for Hawaii homeowners. However, we reserve the right to introduce commercial offerings in the future, which may include:

  • Premium subscription tiers with enhanced data access, features, or analytics
  • Data licensing or API access for authorized commercial use cases
  • Certification, verification, or badge programs for solar installers
  • Advertising or sponsored placements from solar-industry participants

Where we introduce a previously free feature as a paid feature, we will provide reasonable advance notice — no less than 30 days — before the feature becomes paid. For material changes to the commercial structure of Bright Neighbors, we will provide notice via email to registered users and/or prominent in-app notice.

Your continued use of Bright Neighbors after any such notice period constitutes acceptance of the revised commercial terms. If you do not accept the new terms, you may discontinue use of Bright Neighbors and request account deletion as described in Section 7.

Any introduction of paid services will not retroactively charge for previously free use, and will not convert anonymized community data you have already contributed into a paid product you have a claim to.

<\!-- SECTION 10: INTELLECTUAL PROPERTY -->

10. Intellectual Property

All original content, visual design, user interface elements, software, source code, algorithms, data compilations, aggregate statistics, charts, maps, and other creative works on Bright Neighbors — excluding underlying public permit records — are the intellectual property of Bright Neighbors and are protected by applicable copyright, trademark, and other intellectual property laws.

The name "Bright Neighbors," the Bright Neighbors logo, and any associated marks are trademarks or service marks of Bright Neighbors. You may not use these marks without prior written permission, except to accurately refer to the Bright Neighbors service in a non-commercial context.

Public permit data: Building permit records sourced from the City & County of Honolulu Department of Planning and Permitting are public records owned by the City & County of Honolulu and used by Bright Neighbors under the City's public records policy. Bright Neighbors claims no ownership over the underlying public permit records themselves, only over the selection, arrangement, compilation, cleaning, and presentation of that data as expressed on this platform.

No license to you: Nothing in these Terms grants you any license to reproduce, distribute, publicly display, create derivative works from, or commercially exploit Bright Neighbors's intellectual property, except for the limited personal, non-commercial browsing use inherent in accessing the platform as intended.

<\!-- SECTION 11: LIMITATION OF LIABILITY -->

11. Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you. In such jurisdictions, Bright Neighbors's liability will be limited to the greatest extent permitted by law.

Risk Acknowledgment

You use Bright Neighbors at your own risk. Before making any solar purchasing decision, you should independently verify all pricing information, obtain multiple quotes from licensed Hawaii contractors, consult with a qualified financial advisor regarding financing, and review current Hawaii and federal incentive programs with a tax professional. Bright Neighbors data is a starting point for your research — not a substitute for professional guidance.

<\!-- SECTION 12: INDEMNIFICATION -->

12. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Bright Neighbors and its officers, directors, employees, contractors, agents, licensors, and successors (collectively, "Indemnified Parties") from and against any and all claims, actions, suits, proceedings, damages, liabilities, losses, costs, and expenses — including reasonable attorneys' fees — arising out of or relating to:

  • Your access to or use of Bright Neighbors
  • Any data, content, or information you submit to Bright Neighbors, including any claim that your submissions infringe the rights of a third party or are false or misleading
  • Your violation of these Terms
  • Your violation of any applicable law, regulation, or third-party right
  • Any transaction or agreement you enter into with a solar installer, financing company, or other third party in connection with information you obtained through Bright Neighbors

Bright Neighbors reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Bright Neighbors's defense of such matter. You may not settle any claim subject to indemnification under this Section without Bright Neighbors's prior written consent.

<\!-- SECTION 13: GOVERNING LAW -->

13. Governing Law

These Terms and any dispute arising out of or related to these Terms or your use of Bright Neighbors shall be governed by and construed in accordance with the laws of the State of Hawaii, without giving effect to any choice-of-law or conflict-of-law rules that would require the application of the laws of any other jurisdiction.

Subject to the paragraph below, you agree that any legal action or proceeding arising out of or related to these Terms or Bright Neighbors shall be brought exclusively in the state or federal courts located in Honolulu County, Hawaii. You hereby irrevocably consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.

Bright Neighbors reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of Bright Neighbors's intellectual property rights or confidential information without the requirement of posting a bond or other security.

Nothing in this Section limits your rights under applicable consumer protection laws that cannot be waived by contract under the laws of the State of Hawaii.

<\!-- SECTION 14: CHANGES -->

14. Changes to These Terms

Bright Neighbors may update or revise these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. Changes become effective upon posting to sunledger.polsia.app/terms unless we specify a later effective date.

Your continued use of Bright Neighbors after the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using Bright Neighbors.

Material changes: For changes that we consider material — such as changes that significantly expand our data-sharing practices, introduce liability obligations on users, or alter the core consent framework in Section 5 — we will provide advance notice via one or more of the following methods: (a) email notification to registered users at the address associated with their account; (b) a prominent banner or in-app notice displayed when you next visit Bright Neighbors; or (c) both. We will endeavor to provide at least 14 days' advance notice of material changes.

We encourage you to periodically review these Terms to stay informed of your rights and obligations. We will maintain an accessible archive of prior versions of these Terms upon request to legal@sunledger.polsia.app.
